These Terms of Service ("Terms") govern your use of the hosting services provided by Lumex Hosting ("we", "us", "our", the "Provider"), operating from Sri Lanka with servers located in Singapore.

By ordering, paying for, or using any of our services, you ("Client") agree to these Terms. If you do not agree, please do not use our services.

1. Services We Provide

1.1 Service Description

We provide:

Minecraft server hosting
Discord bot hosting
VPS hosting
VPN service

All services run on Intel hardware in Singapore.

1.2 Service Changes

We may add, modify, or discontinue services or plan specifications. Where a change affects an active service, we will give reasonable notice through Discord or email.

2. Service Levels and Support

2.1 Uptime

We target 99.8% network uptime on a best-effort basis. This target excludes scheduled maintenance, issues caused by the Client's own configuration, and events outside our control. It is a target, not a contractual guarantee.

We aim to respond to tickets within a few hours. Most issues are handled the same day.

3. Your Responsibilities

3.1 Account Security

You are responsible for keeping your billing and panel credentials secure, and for all activity that takes place on your service.

3.2 Backups

Automated backups are available on our services, but you remain responsible for keeping your own copies of important data. We are not liable for data loss.

3.3 Content

You are responsible for everything you upload, install, or run on your service, including plugins, mods, bots and scripts.

4. Billing and Payments

4.1 Billing Cycle

All services are billed monthly, in advance, in Sri Lankan Rupees (LKR). There are no setup fees and no long-term contracts.

4.2 Payment Processing

Payments are handled by third-party payment providers. We do not store or process your card or banking details ourselves.

We are not liable for problems originating with a payment provider, including failed or delayed transactions, declined payments, or gateway downtime. We may change payment providers at any time.

4.3 Renewal and Suspension

Invoices are issued before the due date, and reminders are sent to your registered email
Services are suspended if payment is not received by the due date
Suspended services are terminated, and their data deleted, 14 days after the due date

4.4 Refunds

A refund may be requested within 24 hours of your first purchase of a service
Renewals, upgrades and repeat orders are not refundable
VPN plans are not refundable once access details have been issued
Refunds are void where the service has been used in breach of Section 5

Refund requests should be raised through a Discord ticket or by email.

5. Acceptable Use

You agree not to use our services for:

DDoS attacks, stress testing, booters, or any attack tooling
Illegal content, piracy, or any unlawful activity under Sri Lankan or Singaporean law
Cryptocurrency mining, or any process designed to consume shared resources unfairly
Spam, phishing, mass unsolicited messaging, or credential harvesting
Scanning, proxying, or relaying traffic to attack or probe third parties
Content that sexualises minors, incites violence, or promotes hatred

Violation may result in immediate suspension or termination without refund, and, where required, referral to the relevant authorities.

5.1 VPN Use

Our VPN is provided for privacy and everyday browsing. It must not be used to attack, scan or gain unauthorised access to any system, to distribute illegal material, or to evade a ban or law enforcement. Serious abuse ends the service immediately and without refund.

5.2 Resource Fairness

Plans are sold with defined RAM, CPU and storage limits. Sustained use beyond your plan's allocation may result in throttling or a request to upgrade.

6. Monitoring

We monitor resource usage, network traffic patterns and abuse reports to keep the platform stable and compliant with these Terms. We do not read the contents of your files except where necessary to investigate a specific abuse report or a support request you raised.

7. Liability

7.1 Limitation

To the extent permitted by law, our total liability for any claim is limited to the amount you paid for the affected service in the month the issue occurred.

We are not liable for downtime, data loss, service interruptions, or loss of revenue, profits or players.

7.2 Disclaimer

Services are provided "as is", without warranties of any kind.

8. Termination

8.1 By You

You may cancel at any time through the billing area or by opening a ticket. Cancellation takes effect at the end of the current billing month; we do not pro-rate part months.

8.2 By Us

We may suspend or terminate a service for breach of these Terms, non-payment, or abuse.

8.3 Data Deletion

Following termination, service data may be permanently deleted without further notice. Please take a backup before cancelling.

9. Intellectual Property

You keep ownership of your data, worlds, code and configurations. We keep ownership of our infrastructure, branding, website and internal systems.

10. Confidentiality

Both parties agree to keep non-public information shared between them confidential, unless disclosure is required by law.

11. Events Outside Our Control

We are not responsible for failures caused by events beyond our reasonable control, including upstream network or datacenter outages, power failures, natural disasters, or government action.

12. Governing Law

These Terms are governed by the laws of Sri Lanka, and disputes fall under the jurisdiction of the courts of Sri Lanka.

13. Age Requirement

You must be at least 18 years old, or have the consent of a parent or guardian, to order a service.

14. Changes to These Terms

We may update these Terms. Material changes will be announced in our Discord server, and the "last updated" date above will change. Continued use after a change means you accept the updated Terms.

15. Privacy

Our Privacy Policy explains what data we collect and how we handle it, and forms part of these Terms.
